According to Section 94 of the Penal Code, an attempt occurs when a person’s intent to commit an offence is demonstrated through acts that begin execution but fail due to circumstances beyond their control.

Elements of a Criminal Attempt

  • Overt Act (Actus Reus): Actual steps toward the crime — not mere preparation.

  • Non-Completion: The act fails due to external factors or interruption.

Punishment

Under Section 94(2), the penalty for an attempt is generally the same as for the completed offence — though courts may reduce sentences based on mitigating circumstances (e.g., first-time offenders).

  • Attempted Theft – Trying to pickpocket but caught before success

  • Attempted Murder – Firing at someone but missing

  • Attempted Rape – Interrupted before completing the act
